Notice concerning orders in relation to solicitors’ practising certificates

  1. This notice concerns applications for orders made pursuant to Section 48(3) of the Solicitors Act 1954, as amended by Section 55(2)(b) of the Solicitors (Amendment) Act 1994, relating to solicitors’ practising certificates.
     
  2. As there are no prevailing Covid-19 public health restrictions, and in light of the fact that PD HC 89 has been revoked by PD HC 108, the following procedure will apply relating to such orders:
  1. The applicant from the date of this notice shall issue a notice of motion in the Central Office which must be supported by a grounding affidavit;
  2. The applicant should serve the papers on the Law Society of Ireland, which will indicate whether the Society is consenting to the application or not;
  3. In the event that the Society does not consent to the application, the matter will be listed before the President in the Professional Disciplinary List in the usual course on the date listed in the notice of motion;
  4. In the event that the Society does consent to the application, the letter of consent from the Society, together with the applicant’s own confirmation of consent, should be sent to the President’s Registrar at hcpresidentregistrar@courts.ie;
  5. These applications will then be presented to the President in chambers and a consent order may be made prior to the matter appearing in the List; and
  6. The order will be provided by the Registrar to the applicant without the need for the parties to attend Court.
  1. This procedure will remain in force until further notice.
